A BILL TO BE ENTITLED
 
AN ACT
  relating to increasing the maximum amount of the administrative fee
  that may be charged for reclaiming a paging device confiscated by a
  school district.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 37.082(b), Education Code, is amended to
  read as follows:
         (b)  The policy may provide for the district to:
               (1)  dispose of a confiscated paging device in any
  reasonable manner after having provided the student's parent and
  the company whose name and address or telephone number appear on the
  device 30 days' prior notice of its intent to dispose of that
  device. The notice shall include the serial number of the device
  and may be made by telephone, telegraph, or in writing; and
               (2)  charge the owner of the device or the student's
  parent a reasonable [an] administrative fee set by the board of
  trustees not to exceed $75 [$15] before the district [it] releases
  the device to the student, parent, or other owner.
         SECTION 2.  Section 37.082(b), Education Code, as amended by
  this Act, applies to a paging device released to a student, parent,
  or other owner on or after the effective date of this Act,
  regardless of whether the paging device was confiscated by the
  school district before, on, or after that date.
         SECTION 3.  This Act takes effect September 1, 2013.
