A BILL TO BE ENTITLED
 
AN ACT
  relating to prohibiting the use of an electronic device to film or
  photograph a traffic accident; creating an offense.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter I, Chapter 545, Transportation Code,
  is amended by adding Section 545.428 to read as follows:
         Sec. 545.428.  USE OF ELECTRONIC DEVICE NEAR TRAFFIC
  ACCIDENTS; OFFENSE. (a) In this section, "wireless communication
  device" has the meaning assigned by Section 545.425.
         (b)  A person operating a motor vehicle may not use an
  electronic device, including a wireless communication device, to
  photograph or film a traffic accident.
         (c)  This section does not apply to a police officer
  operating an authorized emergency vehicle equipped with a video
  camera.
         SECTION 2.  This Act takes effect September 1, 2017.
