relating to prohibiting the use of an electronic device to film or | ||
photograph a traffic accident; creating an offense. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter I, Chapter 545, Transportation Code, | ||
is amended by adding Section 545.428 to read as follows: | ||
Sec. 545.428. USE OF ELECTRONIC DEVICE NEAR TRAFFIC | ||
ACCIDENTS; OFFENSE. (a) In this section, "wireless communication | ||
device" has the meaning assigned by Section 545.425. | ||
(b) A person operating a motor vehicle may not use an | ||
electronic device, including a wireless communication device, to | ||
photograph or film a traffic accident. | ||
(c) This section does not apply to a police officer | ||
operating an authorized emergency vehicle equipped with a video | ||
camera. | ||
SECTION 2. This Act takes effect September 1, 2017. |
