| relating to prohibiting the use of an electronic device to film or | ||
| photograph a traffic accident; creating an offense. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter I, Chapter 545, Transportation Code, | ||
| is amended by adding Section 545.428 to read as follows: | ||
| Sec. 545.428. USE OF ELECTRONIC DEVICE NEAR TRAFFIC | ||
| ACCIDENTS; OFFENSE. (a) In this section, "wireless communication | ||
| device" has the meaning assigned by Section 545.425. | ||
| (b) A person operating a motor vehicle may not use an | ||
| electronic device, including a wireless communication device, to | ||
| photograph or film a traffic accident. | ||
| (c) This section does not apply to a police officer | ||
| operating an authorized emergency vehicle equipped with a video | ||
| camera. | ||
| SECTION 2. This Act takes effect September 1, 2017. | ||
