| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 318.021, Local Government Code, is | ||
| amended to read as follows: | ||
| Sec. 318.021. APPROPRIATIONS TO HISTORICAL FOUNDATIONS: | ||
| CERTAIN COUNTIES. The commissioners court of a county with a | ||
| population of 150,000 [ |

| from the general fund of the county to a historical foundation or | ||
| organization in the county for the purpose of purchasing, | ||
| constructing, restoring, preserving, maintaining, or | ||
| reconstructing historical landmarks, buildings, and furnishings | ||
| that are of historical significance to the county. The foundation | ||
| or organization must be incorporated under the law of this state as | ||
| a nonprofit corporation. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2021. | ||
