| relating to the eligibility of certain physicians to provide and | ||
| receive remuneration for workers' compensation health care | ||
| services. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 408.023(r), Labor Code, is amended to | ||
| read as follows: | ||
| (r) Notwithstanding the waiver or expiration of Subsections | ||
| (a)-(g) and (i), [ |
||
|
|
||
|
|
||
|
|
||
| considered to be removed from the workers' compensation system if | ||
| the doctor [ |
||
| (1) before September 1, 2007: | ||
| (A) was removed or deleted from the list of | ||
| approved doctors either by action of the Texas Workers' | ||
| Compensation Commission or the division or by agreement with the | ||
| doctor; | ||
| (B) was not admitted to the list of approved | ||
| doctors either by action of the Texas Workers' Compensation | ||
| Commission or the division or by agreement with the doctor; | ||
| (C) was suspended from the list of approved | ||
| doctors either by action of the Texas Workers' Compensation | ||
| Commission or the division or by agreement with the doctor; or | ||
| (D) had the doctor's license to practice | ||
| suspended by the appropriate licensing agency, including a | ||
| suspension that was stayed, deferred, or probated, or voluntarily | ||
| relinquished the license to practice; and | ||
| (2) was not reinstated or restored by the Texas | ||
| Workers' Compensation Commission or the division: | ||
| (A) to the list of approved doctors; or | ||
| (B) to the workers' compensation system [ |

| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2015. | ||
