| relating to an affirmative defense to the offense of operating a | ||
| vehicle without displaying two license plates. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 504.943, Transportation Code, is amended | ||
| by adding Subsection (d-1) to read as follows: | ||
| (d-1) It is an affirmative defense to prosecution under | ||
| Subsection (a) for failure to display a license plate at the front | ||
| of a vehicle that the vehicle: | ||
| (1) is equipped with driving sensors the functioning | ||
| of which would be impaired by the display of a front license plate; | ||
| or | ||
| (2) was not equipped by the manufacturer with a | ||
| mounting plate for a front license plate. | ||
| SECTION 2. The change in law made by this Act applies only | ||
| to an offense committed on or after the effective date of this Act. | ||
| An offense committed before the effective date of this Act is | ||
| covered by the law in effect on the date the offense was committed, | ||
| and the former law is continued in effect for that purpose. For | ||
| purposes of this section, an offense was committed before the | ||
| effective date of this Act if any element of the offense occurred | ||
| before that date. | ||
| SECTION 3. This Act takes effect September 1, 2019. | ||
