A BILL TO BE ENTITLED
 
AN ACT
  relating to the board of trustees of the Texas County and District
  Retirement System.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 845.001, Government Code, is amended to
  read as follows:
         Sec. 845.001.  COMPOSITION OF BOARD OF TRUSTEES. (a)  The
  board of trustees is composed of nine members as follows:
               (1)  four members who serve on a county commissioners
  court of a participating subdivision;
               (2)  one member who serves on the governing body of a
  participating special district;
               (3)  one member who is an employee or retiree of a
  participating county; and
               (4)  three persons who are representatives of the
  public.
         (b)  A member of the board of trustees described by
  Subsection (a)(1), (2), or (3) may not reside in the same county as
  another member.
         SECTION 2.  Section 845.003, Government Code, is amended by
  amending Subsections (a) and (b) and adding Subsections (a-1) and
  (a-2) to read as follows:
         (a)  Except as provided by Subsection (a-1), to [To] be
  eligible to serve as a trustee a person must be[:
               [(1)]  a member or retiree of the retirement system
  [and an employee of a participating subdivision; or
               [(2)  a retiree of the retirement system].
         (a-1)  To be eligible to serve as a trustee who is a
  representative of the public, a person may not:
               (1)  be a member or retiree of the retirement system;
               (2)  hold or have held an elected office; or
               (3)  be or have been an employee of a governmental
  entity.
         (a-2)  A trustee who is a representative of the public may
  not vote on any matter in which the trustee has a pecuniary
  interest.  Failure to comply with this subsection is a ground for
  removal from the board of trustees.
         (b)  If a person serving as a trustee ceases to meet an
  eligibility requirement under Section 845.001 or this section
  [Subsection (a)], the person shall vacate the office of trustee.
         SECTION 3.  The change in law made by this Act to Sections
  845.001 and 845.003, Government Code, regarding the composition of
  and eligibility requirements for the board of trustees of the Texas
  County and District Retirement System, does not affect the
  entitlement of a member serving on the board immediately before the
  effective date of this Act to continue to serve as a member of the
  board for the remainder of the member's term. As the terms of board
  members expire or as a vacancy occurs on the board, the governor
  shall appoint a member to the board as necessary to comply with
  Sections 845.001 and 845.003, Government Code, as amended by this
  Act.
         SECTION 4.  This Act takes effect September 1, 2017.
