BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 32, Election Code, is amended by adding | ||
Subchapter Z to read as follows: | ||
SUBCHAPTER Z. MISCELLANEOUS PROVISIONS | ||
Sec. 32.901. DEFENSE OF SUIT AGAINST ELECTION JUDGES AND | ||
CLERKS. A district attorney shall defend an action, including an | ||
action for writ of mandamus, brought against an election judge or | ||
election clerk that alleges that the judge or clerk violated a | ||
provision of this code while acting in the judge's or clerk's | ||
official capacity in the county served by the district attorney. | ||
SECTION 2. The change in law made by this Act applies only | ||
to an action filed on or after the effective date of this Act. | ||
SECTION 3. This Act takes effect September 1, 2023. |
