| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Sections 225.021(b) and (c), Transportation | ||
| Code, are amended to read as follows: | ||
| (b) The department shall [ |
||
| made to assist in financing the construction and maintenance of a | ||
| marker. | ||
| (c) The department may not [ |
||
| construct, or erect a marker under this subchapter unless a grant or | ||
| donation of funds is made to the department to cover the cost of the | ||
| design, construction, and erection of the marker. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2013. | ||
