A BILL TO BE ENTITLED
 
AN ACT
  relating to a requirement that school districts and open-enrollment
  charter schools report certain information regarding children with
  disabilities who reside in residential facilities.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 29.012, Education Code, is amended by
  adding Subsection (c-1) to read as follows:
         (c-1)  The commissioner by rule shall require each school
  district and open-enrollment charter school to include in the
  district's or school's Public Education Information Management
  System (PEIMS) report the number of children with disabilities
  residing in a residential facility who:
               (1)  are required to be tracked by the Residential
  Facility Monitoring (RFM) System; and
               (2)  receive educational services from the district or
  school.
         SECTION 2.  This Act applies beginning with the 2017-2018
  school year.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2017.
