| relating to a requirement that school districts and open-enrollment | ||
| charter schools report certain information regarding children with | ||
| disabilities who reside in residential facilities. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 29.012, Education Code, is amended by | ||
| adding Subsection (c-1) to read as follows: | ||
| (c-1) The commissioner by rule shall require each school | ||
| district and open-enrollment charter school to include in the | ||
| district's or school's Public Education Information Management | ||
| System (PEIMS) report the number of children with disabilities | ||
| residing in a residential facility who: | ||
| (1) are required to be tracked by the Residential | ||
| Facility Monitoring (RFM) System; and | ||
| (2) receive educational services from the district or | ||
| school. | ||
| SECTION 2. This Act applies beginning with the 2017-2018 | ||
| school year. | ||
| SECTION 3. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2017. | ||
