relating to permitting a residency requirement for police officers | ||
in certain municipalities. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 150.021(b), Local Government Code, is | ||
amended to read as follows: | ||
(b) The prohibition under Subsection (a) does not apply to | ||
residency requirements for: | ||
(1) candidates for or holders of a municipal office, | ||
including a position on the governing body of the municipality; | ||

(2) municipal department heads appointed by the mayor | ||
or governing body of the municipality; or | ||
(3) peace officers as defined by Article 2.12, Code of | ||
Criminal Procedure, or other law, employed by a municipality with a | ||
population of two million or more. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2015. |
