| relating to permitting a residency requirement for police officers | ||
| in certain municipalities. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 150.021(b), Local Government Code, is | ||
| amended to read as follows: | ||
| (b) The prohibition under Subsection (a) does not apply to | ||
| residency requirements for: | ||
| (1) candidates for or holders of a municipal office, | ||
| including a position on the governing body of the municipality; | ||

| (2) municipal department heads appointed by the mayor | ||
| or governing body of the municipality; or | ||
| (3) peace officers as defined by Article 2.12, Code of | ||
| Criminal Procedure, or other law, employed by a municipality with a | ||
| population of two million or more. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2015. | ||
