A BILL TO BE ENTITLED
 
AN ACT
  relating to consideration by the board of trustees of a school
  district of parental complaints regarding student or parent
  participation in an extracurricular activity.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 26.011(b), Education Code, is amended to
  read as follows:
         (b)  The board of trustees of a school district is not
  required by Subsection (a) or Section 11.1511(b)(13) to address a
  complaint that the board receives concerning, relating to, or
  arising from a student's or parent's participation in an
  extracurricular activity that does not involve a violation of a
  right guaranteed by this chapter. This subsection does not affect a
  claim brought by a parent under the Individuals with Disabilities
  Education Act (20 U.S.C. Section 1400 et seq.) or a successor
  federal statute addressing special education services for a child
  with a disability.
         SECTION 2.  This Act applies beginning with the 2021-2022
  school year.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution. If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2021.
