| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter A, Chapter 375, Local Government | ||
| Code, is amended by adding Section 375.005 to read as follows: | ||
| Sec. 375.005. SUNSET REVIEW OF MUNICIPAL MANAGEMENT | ||
| DISTRICTS IN CERTAIN COUNTIES. (a) A municipal management or other | ||
| district to which this chapter applies or that incorporates a power | ||
| provided by this chapter is subject to review under Chapter 325, | ||
| Government Code (Texas Sunset Act), as if it were a state agency | ||
| subject to review under that chapter but may not be abolished under | ||
| that chapter without further legislative action. | ||
| (b) A district shall be reviewed as if the district were | ||
| scheduled to be abolished on September 1 of the eighth year after | ||
| the date the bill creating the district was enacted. | ||
| (c) This section applies only to a district located in a | ||
| county with a population of 3.3 million or more. | ||
| (d) A district shall pay the cost incurred by the Sunset | ||
| Advisory Commission in performing a review of the district under | ||
| this section. The Sunset Advisory Commission shall determine the | ||
| cost, and the district shall pay the amount promptly on receipt of a | ||
| statement from the Sunset Advisory Commission detailing the cost. | ||
| SECTION 2. Section 375.005, Local Government Code, as added | ||
| by this Act, applies only to a district created on or after the | ||
| effective date of this Act. | ||
| SECTION 3. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2015. | ||
