| relating to availability of certain health benefit plan options for | ||
| certain participants in the Texas Public School Employees Group | ||
| Insurance Program. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter D, Chapter 1575, Insurance Code, is | ||
| amended by adding Section 1575.171 to read as follows: | ||
| Sec. 1575.171. APPLICABILITY OF FORMER LAW. (a) | ||
| Notwithstanding the change in law made by Chapter 712 (H.B. 3976), | ||
| Acts of the 85th Legislature, Regular Session, 2017, the trustee | ||
| shall continue to offer and administer the health benefit plan | ||
| options offered under this chapter as it existed immediately before | ||
| September 1, 2017, for participating retirees, dependents, | ||
| surviving spouses, or surviving dependent children who are enrolled | ||
| in a health benefit plan offered under the group program in the 2017 | ||
| plan year, and the former law is continued in effect for that | ||
| purpose. | ||
| (b) The change in law made by Chapter 712 (H.B. 3976), Acts | ||
| of the 85th Legislature, Regular Session, 2017, applies only to | ||
| retirees, dependents, surviving spouses, or surviving dependent | ||
| children who enroll in a health benefit plan offered under the group | ||
| program beginning with the 2020 plan year or a subsequent plan year. | ||
| SECTION 2. This Act takes effect September 1, 2019. | ||
