relating to an objection to the judge assigned in a criminal case. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 74.053(b), Government Code, is amended | ||
to read as follows: | ||
(b) If a party to a civil or criminal case files a timely | ||
objection to the assignment, the judge shall not hear the case. | ||
Except as provided by Subsection (d), each party to the case is only | ||
entitled to one objection under this section for that case. | ||
SECTION 2. The change in law made by this Act applies only | ||
to the right to object to the assignment of a judge assigned under | ||
Chapter 74, Government Code, on or after the effective date of this | ||
Act. An objection to the assignment of a judge assigned under | ||
Chapter 74, Government Code, before the effective date of this Act | ||
is governed by the law in effect on the date of assignment, and the | ||
former law is continued in effect for that purpose. | ||
SECTION 3. This Act takes effect September 1, 2019. |
