A BILL TO BE ENTITLED
 
AN ACT
  relating to reports to the legislature on certain administrative
  hearings regarding the automatic suspension of a person's driver's
  license.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter D, Chapter 524, Transportation Code,
  is amended by adding Section 524.045 to read as follows:
         Sec. 524.045.  QUARTERLY REPORTS TO LEGISLATURE. (a) Not
  later than the 30th day following the end of each calendar quarter,
  the State Office of Administrative Hearings shall submit a report
  to the legislature indicating for each county the total number of
  administrative hearings decided under this chapter during the
  previous calendar quarter and, of those hearings:
               (1)  the percentage in which the administrative law
  judge decided in favor of the person who requested the hearing; and
               (2)  the percentage in which the administrative law
  judge decided in favor of the department.
         (b)  Not later than the 30th day following the end of each
  calendar quarter, the department shall submit a report to the
  legislature indicating for each county the total number of appeals
  from administrative hearings held under this chapter that were
  decided during the previous calendar quarter and, of those appeals:
               (1)  the percentage in which the court decided in favor
  of the person whose license was suspended; and
               (2)  the percentage in which the court decided in favor
  of the department.
         SECTION 2.  The State Office of Administrative Hearings and
  the Department of Public Safety shall submit the initial reports
  required by Section 524.045, Transportation Code, as added by this
  Act, not later than January 30, 2012, based on data from the
  previous calendar quarter.
         SECTION 3.  This Act takes effect September 1, 2011.
