relating to reports to the legislature on certain administrative | ||
hearings regarding the automatic suspension of a person's driver's | ||
license. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter D, Chapter 524, Transportation Code, | ||
is amended by adding Section 524.045 to read as follows: | ||
Sec. 524.045. QUARTERLY REPORTS TO LEGISLATURE. (a) Not | ||
later than the 30th day following the end of each calendar quarter, | ||
the State Office of Administrative Hearings shall submit a report | ||
to the legislature indicating for each county the total number of | ||
administrative hearings decided under this chapter during the | ||
previous calendar quarter and, of those hearings: | ||
(1) the percentage in which the administrative law | ||
judge decided in favor of the person who requested the hearing; and | ||
(2) the percentage in which the administrative law | ||
judge decided in favor of the department. | ||
(b) Not later than the 30th day following the end of each | ||
calendar quarter, the department shall submit a report to the | ||
legislature indicating for each county the total number of appeals | ||
from administrative hearings held under this chapter that were | ||
decided during the previous calendar quarter and, of those appeals: | ||
(1) the percentage in which the court decided in favor | ||
of the person whose license was suspended; and | ||
(2) the percentage in which the court decided in favor | ||
of the department. | ||
SECTION 2. The State Office of Administrative Hearings and | ||
the Department of Public Safety shall submit the initial reports | ||
required by Section 524.045, Transportation Code, as added by this | ||
Act, not later than January 30, 2012, based on data from the | ||
previous calendar quarter. | ||
SECTION 3. This Act takes effect September 1, 2011. |
