| relating to reports to the legislature on certain administrative | ||
| hearings regarding the automatic suspension of a person's driver's | ||
| license. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter D, Chapter 524, Transportation Code, | ||
| is amended by adding Section 524.045 to read as follows: | ||
| Sec. 524.045. QUARTERLY REPORTS TO LEGISLATURE. (a) Not | ||
| later than the 30th day following the end of each calendar quarter, | ||
| the State Office of Administrative Hearings shall submit a report | ||
| to the legislature indicating for each county the total number of | ||
| administrative hearings decided under this chapter during the | ||
| previous calendar quarter and, of those hearings: | ||
| (1) the percentage in which the administrative law | ||
| judge decided in favor of the person who requested the hearing; and | ||
| (2) the percentage in which the administrative law | ||
| judge decided in favor of the department. | ||
| (b) Not later than the 30th day following the end of each | ||
| calendar quarter, the department shall submit a report to the | ||
| legislature indicating for each county the total number of appeals | ||
| from administrative hearings held under this chapter that were | ||
| decided during the previous calendar quarter and, of those appeals: | ||
| (1) the percentage in which the court decided in favor | ||
| of the person whose license was suspended; and | ||
| (2) the percentage in which the court decided in favor | ||
| of the department. | ||
| SECTION 2. The State Office of Administrative Hearings and | ||
| the Department of Public Safety shall submit the initial reports | ||
| required by Section 524.045, Transportation Code, as added by this | ||
| Act, not later than January 30, 2012, based on data from the | ||
| previous calendar quarter. | ||
| SECTION 3. This Act takes effect September 1, 2011. | ||
