A BILL TO BE ENTITLED
 
AN ACT
  relating to requiring Health and Human Services Commission
  contractors to report certain information regarding
  subcontractors.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 531, Government Code, is
  amended by adding Section 531.0185 to read as follows:
         Sec. 531.0185.  SUBCONTRACTOR INFORMATION CLAUSE. (a) The
  commission shall include in each contract the commission enters
  into a clause that requires any contractor to disclose the
  following information relating to any subcontractor under the
  contract:
               (1)  the process the contractor uses to select
  subcontractors;
               (2)  the number of persons who submit subcontractor
  proposals to the contractor and the name of each person who:
                     (A)  submits a proposal to be a subcontractor; and
                     (B)  is awarded a subcontract under the contract;
  and
               (3)  the reasons for the contractor's selection of one
  subcontractor over another subcontractor.
         (b)  Not later than September 1 of each year, the commission
  shall submit a report to the legislature and the presiding officer
  of each legislative standing committee with jurisdiction over the
  commission that includes a summary of the information collected
  from reports submitted under this section.
         SECTION 2.  Section 531.0185, Government Code, as added by
  this Act, applies only to a contract entered into on or after the
  effective date of this Act.  A contract entered into before the
  effective date of this Act is governed by the law in effect on the
  date the contract was entered into, and the former law is continued
  in effect for that purpose.
         SECTION 3.  This Act takes effect September 1, 2023.
