relating to the creation of a waste tire dumping enforcement grant | ||
program; authorizing a fee. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 361, Health and Safety Code, is amended | ||
by adding Subchapter P to read as follows: | ||
SUBCHAPTER P. WASTE TIRE DUMPING ENFORCEMENT GRANT PROGRAM | ||
Sec. 361.471. DEFINITIONS. In this subchapter, "used tire" | ||
means a tire that: | ||
(1) has been used as a tire on a vehicle; and | ||
(2) can still be used for its original intended | ||
purpose. | ||
Sec. 361.472. COLLECTION OF FEE ON SALE OF TIRE. (a) A | ||
seller shall collect a fee in an amount to be determined by the | ||
commission on the sale of each new or used tire. | ||
(b) On a schedule determined by the commission, a seller | ||
shall remit fees collected under Subsection (a) to the comptroller | ||
for deposit into an account in the general revenue fund to be used | ||
to fund the grant program under Section 361.473. | ||
Sec. 361.473. GRANT PROGRAM. The commission shall develop | ||
and implement a program to provide grants to local law enforcement | ||
agencies to assist those agencies in the enforcement of laws | ||
related to the illegal dumping of tires. | ||
SECTION 2. This Act takes effect September 1, 2017. |
