A BILL TO BE ENTITLED
 
AN ACT
  relating to the creation of a waste tire dumping enforcement grant
  program; authorizing a fee.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 361, Health and Safety Code, is amended
  by adding Subchapter P to read as follows:
  SUBCHAPTER P. WASTE TIRE DUMPING ENFORCEMENT GRANT PROGRAM
         Sec. 361.471.  DEFINITIONS. In this subchapter, "used tire"
  means a tire that:
               (1)  has been used as a tire on a vehicle; and
               (2)  can still be used for its original intended
  purpose.
         Sec. 361.472.  COLLECTION OF FEE ON SALE OF TIRE. (a) A
  seller shall collect a fee in an amount to be determined by the
  commission on the sale of each new or used tire.
         (b)  On a schedule determined by the commission, a seller
  shall remit fees collected under Subsection (a) to the comptroller
  for deposit into an account in the general revenue fund to be used
  to fund the grant program under Section 361.473.
         Sec. 361.473.  GRANT PROGRAM. The commission shall develop
  and implement a program to provide grants to local law enforcement
  agencies to assist those agencies in the enforcement of laws
  related to the illegal dumping of tires.
         SECTION 2.  This Act takes effect September 1, 2017.
