| relating to amending the Texas General Arbitration Act. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 16.073, Subchapter D, Chapter 16, Civil | ||
| Practice and Remedies Code, is amended by striking Subsections (a) | ||
| and (b) and substituting the following: | ||
| Sec. 16.073. APPLICABILITY OF LIMITATIONS PERIODS TO | ||
| ARBITRATION. A claim sought to be arbitrated is subject to the same | ||
| limitations of time for the commencement of actions as if the claims | ||
| had been asserted in a court. Commencing an action by filing suit | ||
| in a court of competent jurisdiction will serve to toll limitations | ||
| of time for binding arbitration of the same action. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect on the 91st day after the last day of the | ||
| legislative session. | ||
