| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 621.101, Transportation Code, is amended | ||
| by adding Subsection (b-2) to read as follows: | ||
| (b-2) Notwithstanding Subsections (a)(1) and (2), a vehicle | ||
| or combination of vehicles that is transporting aggregates, as | ||
| defined by Section 28A.001, Water Code, may operate at an axle | ||
| weight that is not heavier than the weight equal to the maximum | ||
| allowable axle weight provided by those subsections plus a | ||
| tolerance allowance of 15 percent of that allowable weight. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2021. | ||
