| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Sec. 22.08, Penal Code, is amended to read as | ||
| follows: | ||
| (a) A person commits an offense if, with intent to promote | ||
| or assist the commission of suicide by another, he incites, aids, or | ||
| attempts to aid the other to commit or attempt to commit suicide. | ||
| (b) An offense under this section is a Class C misdemeanor | ||
| unless the actor's conduct causes suicide or attempted suicide that | ||
| results in serious bodily injury, in which event the offense is a | ||
| state jail felony. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2019. | ||
