| relating to exceptions from the requirement for a person under the | ||
| direction or control of a local entity or campus police department | ||
| to assist or cooperate with federal immigration officers. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 752.053(c), Government Code, is amended | ||
| to read as follows: | ||
| (c) Notwithstanding Subsection (b)(3), a local entity or | ||
| campus police department may prohibit persons who are employed by | ||
| or otherwise under the direction or control of the entity or | ||
| department from assisting or cooperating with a federal immigration | ||
| officer if the assistance or cooperation occurs: | ||
| (1) at a place of worship; | ||
| (2) on the property of a school district, | ||
| open-enrollment charter school, or private school; | ||
| (3) at an institution of higher education; or | ||
| (4) at a hospital, emergency clinic, outpatient | ||
| clinic, birthing center, ambulatory surgical center, or other | ||
| facility providing health care services. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2019. | ||
