relating to applications for certain alcoholic beverage permits and | ||
licenses. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 11.46, Alcoholic Beverage Code, is | ||
amended by adding Subsection (e) to read as follows: | ||
(e) The commission or administrator shall refuse to issue an | ||
original permit authorizing the retail sale of alcoholic beverages | ||
to an applicant who has been refused the same type of permit for the | ||
same premises three or more times. | ||
SECTION 2. Section 61.42, Alcoholic Beverage Code, is | ||
amended by adding Subsection (e) to read as follows: | ||
(e) The county judge, commission, or administrator shall | ||
refuse to approve or issue an original license authorizing the | ||
retail sale of alcoholic beverages to an applicant who has been | ||
refused the same type of license for the same premises three or more | ||
times. | ||
SECTION 3. The changes in law made by this Act apply only | ||
with respect to an original alcoholic beverage permit or license | ||
application made on or after the effective date of this Act. | ||
SECTION 4. This Act takes effect September 1, 2017. |
