A BILL TO BE ENTITLED
 
AN ACT
  relating to the dispensing of certain medications by therapeutic
  optometrists.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter H, Chapter 351, Occupations Code, is
  amended by adding Section 351.3585 to read as follows:
         Sec. 351.3585.  DISPENSING MEDICATION PERMITTED; FEE
  AUTHORIZED. A therapeutic optometrist may:
               (1)  without complying with Chapter 558, dispense to a
  patient of the therapeutic optometrist any medication within the
  scope of practice of a therapeutic optometrist; and
               (2)  charge a fee for dispensing a medication under
  this section.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2019.
