| optometrists. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter H, Chapter 351, Occupations Code, is | ||
| amended by adding Section 351.3585 to read as follows: | ||
| Sec. 351.3585. DISPENSING MEDICATION PERMITTED; FEE | ||
| AUTHORIZED. A therapeutic optometrist may: | ||
| (1) without complying with Chapter 558, dispense to a | ||
| patient of the therapeutic optometrist any medication within the | ||
| scope of practice of a therapeutic optometrist; and | ||
| (2) charge a fee for dispensing a medication under | ||
| this section. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2019. | ||
