| relating to public acknowledgment of donations made to the Texas | ||
| Department of Transportation. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 201.206, Transportation Code, is amended | ||
| to read as follows: | ||
| Sec. 201.206. DONATIONS AND CONTRIBUTIONS. (a) For the | ||
| purpose of carrying out its functions and duties, the department | ||
| may accept, from any source, a donation or contribution in any form, | ||
| including realty, personalty, money, materials, or services. | ||
| (b) The department may enter into an agreement with a donor | ||
| to publicly acknowledge donations made to the department. The | ||
| public acknowledgment may not contain comparative or qualitative | ||
| descriptions of the donor's products, services, facilities, or | ||
| companies. | ||
| (c) If a person makes a donation to the department's | ||
| roadside assistance and safety service patrol program, the | ||
| department may post an acknowledgment of the donation on a vehicle | ||
| or equipment the department uses for the program. | ||
| (d) The commission may adopt rules for the acknowledgment of | ||
| donations under this section. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2023. | ||
