A BILL TO BE ENTITLED
 
AN ACT
  relating to coverage for low-THC cannabis under certain group
  benefit plans for governmental employees.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter E, Chapter 1551, Insurance Code, is
  amended by adding Section 1551.231 to read as follows:
         Sec. 1551.231.  COVERAGE FOR LOW-THC CANNABIS.  A health
  benefit plan offered under the group benefits program must provide
  coverage for low-THC cannabis prescribed to a participant under
  Chapter 169, Occupations Code. 
         SECTION 2.  Subchapter D, Chapter 1575, Insurance Code, is
  amended by adding Section 1575.174 to read as follows:
         Sec. 1575.174.  COVERAGE FOR LOW-THC CANNABIS.  A health
  benefit plan offered under the group program, other than a Medicare
  Advantage plan or a Medicare prescription drug plan, must provide
  coverage for low-THC cannabis prescribed to an enrollee under
  Chapter 169, Occupations Code.
         SECTION 3.  Subchapter C, Chapter 1579, Insurance Code, is
  amended by adding Section 1579.112 to read as follows:
         Sec. 1579.112.  COVERAGE FOR LOW-THC CANNABIS.  A health
  coverage plan provided under this chapter must provide coverage for
  low-THC cannabis prescribed to an enrollee under Chapter 169,
  Occupations Code.
         SECTION 4.  The change in law made by this Act applies only
  to a plan year that commences on or after January 1, 2022.
         SECTION 5.  This Act takes effect September 1, 2021.
