| relating to the authority of certain counties to acquire a | ||
| right-of-way in accordance with the county's master drainage plan. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Chapter 561, Local Government Code, is amended | ||
| by adding Section 561.0075 to read as follows: | ||
| Sec. 561.0075. AUTHORITY TO ACQUIRE RIGHT-OF-WAY REQUIRED | ||
| BY MASTER DRAINAGE PLAN IN CERTAIN COUNTIES. (a) This section | ||
| applies only to a county with a population of 3.3 million or more. | ||
| (b) After notice is published in a newspaper of general | ||
| circulation in the county, the commissioners court of a county may | ||
| by order acquire a right-of-way on a strip of land that is | ||
| undeveloped or part of a new site development or redevelopment plan | ||
| if the acquisition is required by the county's master drainage | ||
| plan. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2019. | ||
