A BILL TO BE ENTITLED
 
AN ACT
  relating to the authority of certain counties to acquire a
  right-of-way in accordance with the county's master drainage plan.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 561, Local Government Code, is amended
  by adding Section 561.0075 to read as follows:
         Sec. 561.0075.  AUTHORITY TO ACQUIRE RIGHT-OF-WAY REQUIRED
  BY MASTER DRAINAGE PLAN IN CERTAIN COUNTIES. (a) This section
  applies only to a county with a population of 3.3 million or more.
         (b)  After notice is published in a newspaper of general
  circulation in the county, the commissioners court of a county may
  by order acquire a right-of-way on a strip of land that is
  undeveloped or part of a new site development or redevelopment plan
  if the acquisition is required by the county's master drainage
  plan.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2019.
