BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 12.115, Education Code, is amended by | ||
adding Subsection (c-2) to read as follows: | ||
(c-2) For purposes of revocation under Subsection (c)(1), | ||
performance for the 2015-2016 school year may not be considered | ||
unacceptable if, but for a data error reported by the | ||
open-enrollment charter school to the Public Education Information | ||
Management System (PEIMS), the school would have received an | ||
acceptable rating under the accountability procedures applicable | ||
to the school. If the school demonstrates that the school would | ||
have received an acceptable rating but for the data error reported | ||
by the school, the commissioner shall assign the school the | ||
corrected rating. This subsection expires September 1, 2019. | ||
SECTION 2. Section 12.115(c-2), Education Code, as added by | ||
this Act, stays a proceeding to revoke a charter or accept the | ||
surrender of a charter in lieu of revocation pending on the | ||
effective date of this Act until the open-enrollment charter school | ||
is given an opportunity to demonstrate a data error claim. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2017. |
