A BILL TO BE ENTITLED
AN ACT
relating to systems of prior authorization for the control,
management, and disposal of certain nonhazardous, industrial solid
wastes for which there are minimum federal requirements.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter C, Chapter 361, Health and Safety
Code, is amended by adding Section 361.0902 to read as follows:
Sec. 361.0902. AUTHORIZATION FOR CONTROL, MANAGEMENT, OR
DISPOSAL OF CERTAIN NONHAZARDOUS, INDUSTRIAL SOLID WASTES;
HEARING. (a) Notwithstanding any other provision of this chapter
relating to permits, the commission by rule may require a
registration that requires prior approval, or other system of prior
approval, for the control, management, or disposal of industrial
solid wastes for which there are minimum federal requirements under
the Resource Conservation and Recovery Act of 1976 (42 U.S
.C.
Section 6901 et seq.).
(b) Public hearings on an application for a registration
that requires prior approval, or other system of prior approval,
required by rules adopted under this section, are not subject to the
procedural requirements of Chapter 2001, Government Code, or
Chapter 5, Water Code.
SECTION 2. Not later than January 1, 2018, the Texas
Commission on Environmental Quality shall adopt rules to implement
Section 361.0902, Health and Safety Code, as added by this Act.
SECTION 3. This Act takes effect September 1, 2017.
