| relating to approval by the commissioner of education of an | ||
| expansion or new school amendment for a charter holder previously | ||
| denied a charter by the State Board of Education. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 12.114, Education Code, is amended by | ||
| adding Subsection (d) to read as follows: | ||
| (d) The commissioner may not approve a request for an | ||
| expansion or new school amendment submitted by a charter holder | ||
| under Subsection (c) if the State Board of Education has previously | ||
| voted against the grant of a new charter as provided by Section | ||
| 12.101(b-0) for an identical or substantially similar campus | ||
| submitted by the charter holder or an affiliate of the charter | ||
| holder. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2015. | ||
