A BILL TO BE ENTITLED
AN ACT
relating to erecting certain signs on private property before an
election.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 391.005, Transportation Code, is amended
to read as follows:
Sec. 391.005. EXEMPTION. This chapter does not apply to a
sign erected solely for and relating to a public election if the
sign:
(1) is on private property;
(2) is erected not earlier than the 90th day before:
(A) the date of the election; or
(B) the first day of the early voting period for
an election with early voting;
(2-a) [and] is removed not later than the 10th day
after the election date;
(3) is constructed of lightweight material; and
(4) has a surface area not larger than 50 square feet.
SECTION 2. The change in law made by this Act applies only
to an offense committed on or after the effective date of this Act.
An offense committed before the effective date of this Act is
governed by the law in effect on the date the offense was committed,
and the former law is continued in effect for that purpose. For
purposes of this section, an offense was committed before the
effective date of this Act if any element of the offense was
committed before that date.
SECTION 3. This Act takes effect September 1, 2015.
