| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 157.265, Family Code, is amended by | ||
| adding Subsection (c-1) to read as follows: | ||
| (c-1) Notwithstanding Subsections (a), (b), and (c), for | ||
| delinquent child support owed by a child support obligor who is | ||
| confined in local, state, or federal jail or prison, the interest | ||
| rate on child support arrearages described by each of those | ||
| subsections accrues at the rate of three percent simple interest | ||
| per year from the date of the obligor's incarceration until the date | ||
| the obligor is released from incarceration. | ||
| SECTION 2. Section 157.265(c-1), Family Code, as added by | ||
| this Act, applies only to the accrual of interest on child support | ||
| arrearages owed by a child support obligor who is incarcerated on or | ||
| after the effective date of this Act. The accrual of interest on | ||
| child support arrearages owed by a child support obligor | ||
| incarcerated before the effective date of this Act is governed by | ||
| the law in effect immediately before the effective date of this Act, | ||
| and the former law is continued in effect for that purpose. | ||
| SECTION 3. This Act takes effect September 1, 2025. | ||
