| relating to the authority of certain municipalities to impose | ||

| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. This Act may be cited as the Entertainment and | ||
| Hospitality Revitalization Act of 2021. | ||
| SECTION 2. Chapter 217, Local Government Code, is amended | ||
| by adding Subchapter Z to read as follows: | ||
| SUBCHAPTER Z. MISCELLANEOUS PROVISIONS | ||
| Sec. 217.901. REGULATION OF SOUND FROM CERTAIN VENUES IN | ||
| CERTAIN MUNICIPALITIES PROHIBITED. (a) This section applies only | ||
| to a municipality with a population of 750,000 or more that is | ||
| primarily located in a county with a population of 1.5 million or | ||
| less. | ||
| (b) A municipality may not adopt or enforce an ordinance | ||
| that regulates the production of amplified sound from a bar if the | ||
| sound is produced: | ||
| (1) from a loudspeaker or sound amplifier at a level | ||
| that does not exceed 85 decibels; and | ||
| (2) at any time between the hours of 10 a.m. and 2 a.m. | ||
| SECTION 3. This Act takes effect September 1, 2021. | ||
