| premises of certain businesses selling or serving alcoholic | ||
| beverages; adding a provision that is subject to a criminal | ||
| penalty. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 106.09, Alcoholic Beverage Code, is | ||
| amended by amending Subsection (a) and adding Subsection (f) to | ||
| read as follows: | ||
| (a) Except as provided by [ |

| 18 years of age to sell, prepare, serve, or otherwise handle liquor, | ||
| or to assist in doing so. | ||
| (f) The holder of a permit or license providing for the | ||
| on-premises consumption of alcoholic beverages that derives less | ||
| than 50 percent of its gross receipts for the premises from the sale | ||
| or service of alcoholic beverages may employ a person under 18 years | ||
| of age to work as a cashier for transactions involving the sale of | ||
| alcoholic beverages if the alcoholic beverages are served by a | ||
| person 18 years of age or older. | ||
| SECTION 2. The change in law made by this Act to Section | ||
| 106.09, Alcoholic Beverage Code, applies only to an offense | ||
| committed on or after the effective date of this Act. An offense | ||
| committed before the effective date of this Act is covered by the | ||
| law in effect when the offense was committed, and the former law is | ||
| continued in effect for that purpose. For purposes of this section, | ||
| an offense was committed before the effective date of this Act if | ||
| any element of the offense occurred before that date. | ||
| SECTION 3. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2015. | ||
