A BILL TO BE ENTITLED
 
AN ACT
  relating to certain calculations made for load shedding in the
  ERCOT power region.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter D, Chapter 39, Utilities Code, is
  amended by adding Section 39.159 to read as follows:
         Sec. 39.159.  LOAD SHED PERCENTAGE CALCULATIONS. (a)  The
  commission by rule shall require each transmission and distribution
  utility, municipally owned utility, and electric cooperative in the
  ERCOT power region to submit annually to the independent
  organization certified for the ERCOT power region a determination
  of the utility's or cooperative's peak load for the summer season
  and peak load for the winter season.
         (b)  The independent organization certified for the ERCOT
  power region shall make annual determinations of load shed
  percentages for use during emergency curtailment based on the peak
  load information submitted under Subsection (a).
         (c)  The independent organization certified for the ERCOT
  power region may use a look-back period to determine load shed
  percentages for use during emergency curtailment if the independent
  organization does not have sufficient information submitted under
  Subsection (a) for the organization to make the determination as
  provided by Subsection (b).
         SECTION 2.  This Act takes effect September 1, 2021.
