relating to certain calculations made for load shedding in the | ||
ERCOT power region. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter D, Chapter 39, Utilities Code, is | ||
amended by adding Section 39.159 to read as follows: | ||
Sec. 39.159. LOAD SHED PERCENTAGE CALCULATIONS. (a) The | ||
commission by rule shall require each transmission and distribution | ||
utility, municipally owned utility, and electric cooperative in the | ||
ERCOT power region to submit annually to the independent | ||
organization certified for the ERCOT power region a determination | ||
of the utility's or cooperative's peak load for the summer season | ||
and peak load for the winter season. | ||
(b) The independent organization certified for the ERCOT | ||
power region shall make annual determinations of load shed | ||
percentages for use during emergency curtailment based on the peak | ||
load information submitted under Subsection (a). | ||
(c) The independent organization certified for the ERCOT | ||
power region may use a look-back period to determine load shed | ||
percentages for use during emergency curtailment if the independent | ||
organization does not have sufficient information submitted under | ||
Subsection (a) for the organization to make the determination as | ||
provided by Subsection (b). | ||
SECTION 2. This Act takes effect September 1, 2021. |
