| relating to certain calculations made for load shedding in the | ||
| ERCOT power region. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter D, Chapter 39, Utilities Code, is | ||
| amended by adding Section 39.159 to read as follows: | ||
| Sec. 39.159. LOAD SHED PERCENTAGE CALCULATIONS. (a) The | ||
| commission by rule shall require each transmission and distribution | ||
| utility, municipally owned utility, and electric cooperative in the | ||
| ERCOT power region to submit annually to the independent | ||
| organization certified for the ERCOT power region a determination | ||
| of the utility's or cooperative's peak load for the summer season | ||
| and peak load for the winter season. | ||
| (b) The independent organization certified for the ERCOT | ||
| power region shall make annual determinations of load shed | ||
| percentages for use during emergency curtailment based on the peak | ||
| load information submitted under Subsection (a). | ||
| (c) The independent organization certified for the ERCOT | ||
| power region may use a look-back period to determine load shed | ||
| percentages for use during emergency curtailment if the independent | ||
| organization does not have sufficient information submitted under | ||
| Subsection (a) for the organization to make the determination as | ||
| provided by Subsection (b). | ||
| SECTION 2. This Act takes effect September 1, 2021. | ||
