relating to the confidentiality of the e-mail address of an | ||
applicant for or holder of a license issued by certain state | ||
agencies. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 552.137(c), Government Code, is amended | ||
to read as follows: | ||
(c) Subsection (a) does not apply to an e-mail address: | ||
(1) provided to a governmental body by a person who has | ||
a contractual relationship with the governmental body or by the | ||
contractor's agent; | ||
(2) provided to a governmental body by a vendor who | ||
seeks to contract with the governmental body or by the vendor's | ||
agent; | ||
(3) contained in a response to a request for bids or | ||
proposals, contained in a response to similar invitations | ||
soliciting offers or information relating to a potential contract, | ||
or provided to a governmental body in the course of negotiating the | ||
terms of a contract or potential contract; | ||
(4) provided to a governmental body on a letterhead, | ||
coversheet, printed document, or other document made available to | ||
the public; [ |

(5) provided to a governmental body for the purpose of | ||
providing public comment on or receiving notices related to an | ||
application for a license as defined by Section 2001.003(2) of this | ||
code, or receiving orders or decisions from a governmental body; or | ||
(6) provided to a governmental body by an applicant | ||
for or holder of a license, as defined by Section 57.001, | ||
Occupations Code, issued by the Department of Agriculture or the | ||
Texas Department of Licensing and Regulation. | ||
SECTION 2. The change in law made by this Act applies only | ||
to a request for information that is received by a governmental body | ||
or an officer for public information on or after the effective date | ||
of this Act. A request for information that was received before the | ||
effective date of this Act is governed by the law in effect on the | ||
date the request was received, and the former law is continued in | ||
effect for that purpose. | ||
SECTION 3. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2019. |
