A BILL TO BE ENTITLED
 
AN ACT
  relating to the sunset review of the Sulphur River Basin Authority.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  SULPHUR RIVER BASIN AUTHORITY.  Chapter 3, Acts
  of the 69th Legislature, 1st Called Session, 1985, is amended by
  adding Section 1A to read as follows:
         Sec. 1A.  APPLICATION OF SUNSET ACT.  (a)  The authority is
  subject to Section 325.025, Government Code.  Unless the authority
  is continued in existence as provided by Chapter 325 of that code,
  on September 1, 2015:
               (1)  the authority is abolished;
               (2)  the assets of the authority are transferred to
  this state; and
               (3)  this Act expires.
         (b)  The abolishment of the authority does not affect any
  existing rights, or existing priorities in the rights, to water
  from the source of supply. The abolishment of the authority is not
  an abandonment or waiver of those rights or priorities and is not an
  abandonment of the original point of diversion from the source of
  supply. All those rights existing at the time of the abolishment of
  the authority are preserved.
         SECTION 2.  EFFECTIVE DATE. This Act takes effect
  immediately if it receives a vote of two-thirds of all the members
  elected to each house, as provided by Section 39, Article III, Texas
  Constitution.  If this Act does not receive the vote necessary for
  immediate effect, this Act takes effect September 1, 2013.
