relating to the adoption of state rules and the submission of the | ||
state implementation plan to comply with certain rules under | ||
Section 111(d) of the federal Clean Air Act. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 382.0173, Health and Safety Code, is | ||
amended by adding Subsection (a-1) to read as follows: | ||
(a-1) The commission or another state agency, including the | ||
Public Utility Commission, may not finally adopt a rule or submit a | ||
state implementation plan to comply with the United States | ||
Environmental Protection Agency's rules under Section 111(d) of the | ||
federal Clean Air Act (42 U.S.C. Section 7411) if those federal | ||
rules give the Environmental Protection Agency authority to | ||
regulate a person, entity, or activity that it did not regulate on | ||
January 1, 2015. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2015. |
