A BILL TO BE ENTITLED
 
AN ACT
  relating to the adoption of state rules and the submission of the
  state implementation plan to comply with certain rules under
  Section 111(d) of the federal Clean Air Act.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 382.0173, Health and Safety Code, is
  amended by adding Subsection (a-1) to read as follows:
         (a-1)  The commission or another state agency, including the
  Public Utility Commission, may not finally adopt a rule or submit a
  state implementation plan to comply with the United States
  Environmental Protection Agency's rules under Section 111(d) of the
  federal Clean Air Act (42 U.S.C. Section 7411) if those federal
  rules give the Environmental Protection Agency authority to
  regulate a person, entity, or activity that it did not regulate on
  January 1, 2015.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2015.
