| expenses of a joint election. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 11.0581, Education Code, is amended by | ||
| adding Subsection (e) to read as follows: | ||
| (e) This subsection applies only to a school district | ||
| located in a county with a population of 3.3 million or more. The | ||
| joint election agreement allocating expenses as provided by Section | ||
| 271.004, Election Code, must provide that a school district is | ||
| responsible only for the proportion of election expenses that | ||
| corresponds to the proportion that the number of precincts located | ||
| within the school district's boundaries bears to the total number | ||
| of precincts participating in the joint election. The agreement | ||
| must also provide that if a precinct is located within the | ||
| boundaries of two or more school districts, each school district is | ||
| responsible only for the proportion of election expenses that | ||
| corresponds to the proportion that the number of the school | ||
| district's registered voters in the precinct bears to the total | ||
| number of registered voters in the precinct. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2011. | ||
