A BILL TO BE ENTITLED
 
AN ACT
  relating to the zoning authority of an eligible barrier island
  municipality.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subtitle A, Title 7 of the Local Government Code
  is amended by adding Section 211.018, to read as follows:
         Section 211.018.  ZONING AUTHORITY OF AN ELIGIBLE BARRIER
  ISLAND MUNICIPALITY
         (a)  An eligible barrier island municipality may, by vote of
  its governing body, extend its zoning regulations to apply within
  the entirety of its extra-
  territorial jurisdiction.
         (b)  If an eligible barrier island municipality exercises
  the authority granted in this section the zoning regulations of the
  eligible barrier island municipality control over any County zoning
  under Chapter 231, Subchapter B of this Code.
         (c)  An eligible barrier island municipality is defined as a
  municipality that:
               (1)  Has a population over 2,000;
               (2)  Is located entirely on a barrier island in the Gulf
  of Mexico; and
               (3)  Is located within 30 miles of an international
  border.
         SECTION 2.  This Act takes effect September 1, 2013.
