A BILL TO BE ENTITLED
AN ACT
relating to audits conducted by the Health and Human Services
Commission's office of inspector general.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter C, Chapter 531, Government Code, is
amended by adding Section 531.1204 to read as follows:
Sec. 531.1204. UNIFORMITY IN AUDITS. (a) To the extent
possible, the commission's office of inspector general shall ensure
that for hospitals, hospital systems, and other providers subject
to audit by the office there is no disparity in the number of times:
(1) each hospital is audited by the office compared to
the number of times all other hospitals are audited;
(2) each hospital system is audited by the office
compared to the number of times all other hospital systems are
audited; and
(3) each other provider is audited by the office
compared to the number of times all other providers are audited.
(b) Subsection (a) only applies to routine audits conducted
by the office. The subsection does not apply to audits conducted as
a result of the suspicion of or an allegation of fraud, waste, or
abuse by a hospital, hospital system, or other provider.
SECTION 2. This Act takes effect September 1, 2017.
