| relating to a prohibition on lottery advertisement and promotion in | ||
| certain low income counties. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 466.110, Government Code, is amended to | ||
| read as follows: | ||
| Sec. 466.110. PROHIBITED ADVERTISEMENTS. (a) The | ||
| legislature intends that advertisements or promotions sponsored by | ||
| the commission or the division for the lottery not be of a nature | ||
| that unduly influences any person to purchase a lottery ticket or | ||
| number. | ||
| (b) The commission or a lottery operator may not advertise | ||
| or promote the lottery in a county with a per capita income at or | ||
| below 150 percent of the federal poverty level. | ||
| (c) A sales agent operating in a county described by | ||
| Subsection (b) may advertise or promote the lottery within the | ||
| sales agent's place of business. | ||
| SECTION 2. This Act takes effect September 1, 2019. | ||
