| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 413.031, Labor Code, is amended by | ||
| adding Subsection (j-1) to read as follows: | ||
| (j-1) After an independent review organization has issued a | ||
| decision under Subsection (d), a party may request a letter of | ||
| clarification from the independent review organization. The party | ||
| making the request shall send a copy of the request to each party | ||
| involved in the dispute. A request for clarification may request | ||
| that the independent review organization reconsider its decision or | ||
| issue a new decision. On receipt of a request for clarification, the | ||
| independent review organization shall reconsider its decision and | ||
| either clarify the original decision or issue a new decision. | ||
| SECTION 2. Section 4202.009, Insurance Code, is repealed. | ||
| SECTION 3. Section 413.031(j-1), Labor Code, as added by | ||
| this Act, applies only to the review of a medical service conducted | ||
| on or after the effective date of this Act. A review of a medical | ||
| service that is conducted before the effective date of this Act is | ||
| governed by the law in effect on the date the review was conducted, | ||
| and the former law is continued in effect for that purpose. | ||
| SECTION 4. This Act takes effect September 1, 2011. | ||
