A BILL TO BE ENTITLED
 
AN ACT
  relating to requiring certain textbook publishers to offer
  electronic textbooks.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter I, Chapter 51, Education Code, is
  amended by adding Section 51.456 to read as follows:
         Sec. 51.456.  ELECTRONIC TEXTBOOKS REQUIRED. (a)  Not later
  than January 1, 2022, a textbook publisher who offers textbooks for
  sale at a college bookstore shall, to the extent practicable, make
  the textbooks available for sale wholly or partly in an electronic
  format.  The electronic version of any textbook must contain the
  same content as the printed version and may be copy-protected.
         (b)  This section does not authorize any use of a textbook or
  other instructional materials that would constitute an
  infringement of copyright under the Copyright Act of 1976 (17
  U.S.C. Section 101 et seq.).
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2017.
