| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter I, Chapter 51, Education Code, is | ||
| amended by adding Section 51.456 to read as follows: | ||
| Sec. 51.456. ELECTRONIC TEXTBOOKS REQUIRED. (a) Not later | ||
| than January 1, 2022, a textbook publisher who offers textbooks for | ||
| sale at a college bookstore shall, to the extent practicable, make | ||
| the textbooks available for sale wholly or partly in an electronic | ||
| format. The electronic version of any textbook must contain the | ||
| same content as the printed version and may be copy-protected. | ||
| (b) This section does not authorize any use of a textbook or | ||
| other instructional materials that would constitute an | ||
| infringement of copyright under the Copyright Act of 1976 (17 | ||
| U.S.C. Section 101 et seq.). | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2017. | ||
