A BILL TO BE ENTITLED
AN ACT
relating to required suicide prevention training for certain health
care practitioners.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter B, Chapter 12, Health and Safety
Code, is amended by adding Section 12.021 to read as follows:
Sec. 12.021. SUICIDE PREVENTION TRAINING COURSES. (a) The
department, in consultation with the state agency responsible for
licensing and regulating the applicable profession, shall approve
suicide prevention training courses for purposes of Sections
156.060, 201.357, 204.158, 301.308, 453.255, 454.255, 501.305,
502.304, 503.357, 504.207, and 505.406, Occupations Code.
(b) A course approved under Subsection (a):
(1) must include training in suicide screening and
referral; and
(2) may include, as applicable, training in:
(A) suicide assessment, other than screening and
referral;
(B) suicide treatment; and
(C) suicide management.
SECTION 2. Subchapter B, Chapter 156, Occupations Code, is
amended by adding Section 156.060 to read as follows:
Sec. 156.060. SUICIDE PREVENTION TRAINING. (a) Each
person licensed to practice medicine in this state shall complete
one hour of suicide prevention training approved by the Department
of State Health Services under Section 12.021, Health and Safety
Code.
(b) The board may not renew the registration permit of a
license holder who does not complete the training required by this
section.
SECTION 3. Subchapter H, Chapter 201, Occupations Code, is
amended by adding Section 201.357 to read as follows:
Sec. 201.357. SUICIDE PREVENTION TRAINING. (a) A license
holder shall complete one hour of suicide prevention training
approved by the Department of State Health Services under Section
12.021, Health and Safety Code.
(b) The board may not renew the license of a license holder
who has not completed the training required by this section.
SECTION 4. Subchapter D, Chapter 204, Occupations Code, is
amended by adding Section 204.158 to read as follows:
Sec. 204.158. SUICIDE PREVENTION TRAINING. (a) A license
holder shall complete one hour of suicide prevention training
approved by the Department of State Health Services under Section
12.021, Health and Safety Code.
(b) The physician assistant board may not renew the license
of a license holder who has not completed the training required by
this section.
SECTION 5. Subchapter G, Chapter 301, Occupations Code, is
amended by adding Section 301.308 to read as follows:
Sec. 301.308. SUICIDE PREVENTION TRAINING. (a) A license
holder shall complete one hour of suicide prevention training
approved by the Department of State Health Services under Section
12.021, Health and Safety Code.
(b) The board may not renew the license of a license holder
who has not completed the training required by this section.
SECTION 6. Subchapter F, Chapter 453, Occupations Code, is
amended by adding Section 453.255 to read as follows:
Sec. 453.255. SUICIDE PREVENTION TRAINING. (a) A license
holder shall complete one hour of suicide prevention training
approved by the Department of State Health Services under Section
12.021, Health and Safety Code.
(b) The board may not renew the license of a license holder
who has not completed the training required by this section.
SECTION 7. Subchapter F, Chapter 454, Occupations Code, is
amended by adding Section 454.255 to read as follows:
Sec. 454.255. SUICIDE PREVENTION TRAINING. (a) A license
holder shall complete six hours of suicide prevention training
approved by the Department of State Health Services under Section
12.021, Health and Safety Code, in the six years preceding the date
the license holder applies for renewal.
(b) The board may not renew the license of a license holder
who does not complete the training required by this section.
(c) A license holder may complete the training required by
this section:
(1) as part of the continuing education program under
Section 454.254; and
(2) in more than one training session.
SECTION 8. Subchapter G, Chapter 501, Occupations Code, is
amended by adding Section 501.305 to read as follows:
Sec. 501.305. SUICIDE PREVENTION TRAINING. (a) A license
holder shall complete six hours of suicide prevention training
approved by the Department of State Health Services under Section
12.021, Health and Safety Code, in the six years preceding the date
the license holder applies for renewal.
(b) The board may not renew the license of a license holder
who does not complete the training required by this section.
(c) A license holder may complete the training required by
this section:
(1) as part of the continuing education program under
Section 501.304; and
(2) in more than one training session.
SECTION 9. Subchapter G, Chapter 502, Occupations Code, is
amended by adding Section 502.304 to read as follows:
Sec. 502.304. SUICIDE PREVENTION TRAINING. (a) A license
holder shall complete six hours of suicide prevention training
approved by the department under Section 12.021, Health and Safety
Code, in the six years preceding the date the license holder applies
for renewal.
(b) The board may not renew the license of a license holder
who does not complete the training required by this section.
(c) A license holder may complete the training required by
this section:
(1) as part of the continuing education program under
Section 502.303; and
(2) in more than one training session.
SECTION 10. Section 503.351, Occupations Code, is amended
to read as follows:
Sec. 503.351. RENEWAL; ELIGIBILITY. A person licensed
under this chapter may renew the license biennially if the person:
(1) is not in violation of this chapter when the person
applies for renewal; [and]
(2) fulfills the continuing education requirements
established by the board; and
(3) fulfills the suicide prevention training
requirement of Section 503.357, as applicable.
SECTION 11. Subchapter H, Chapter 503, Occupations Code, is
amended by adding Section 503.357 to read as follows:
Sec. 503.357. SUICIDE PREVENTION TRAINING. (a) A license
holder shall complete six hours of suicide prevention training
approved by the department under Section 12.021, Health and Safety
Code, in the six years preceding the date the license holder applies
for renewal.
(b) The board may not renew the license of a license holder
who does not complete the training required by this section.
(c) A license holder may complete the training required by
this section:
(1) as part of the continuing education program under
Section 503.356; and
(2) in more than one training session.
SECTION 12. Section 504.202, Occupations Code, is amended
to read as follows:
Sec. 504.202. NOTICE OF LICENSE EXPIRATION AND REQUIREMENTS
TO RENEW. Not later than the 31st day before the expiration date of
a person's license, the department shall send to the license holder
at the license holder's last known address according to department
records written notice of:
(1) the impending license expiration;
(2) the amount of the renewal fee; [and]
(3) any continuing education required to renew the
license; and
(4) the suicide prevention training required to renew
the license, if applicable.
SECTION 13. Subchapter E, Chapter 504, Occupations Code, is
amended by adding Section 504.207 to read as follows:
Sec. 504.207. SUICIDE PREVENTION TRAINING. (a) A license
holder shall complete six hours of suicide prevention training
approved by the department under Section 12.021, Health and Safety
Code, in the six years preceding the date the license holder applies
for renewal.
(b) The department may not renew the license of a license
holder who does not complete the training required by this section.
(c) A license holder may complete the training required by
this section:
(1) as part of the continuing education program under
Section 504.205; and
(2) in more than one training session.
SECTION 14. Subchapter H, Chapter 505, Occupations Code, is
amended by adding Section 505.406 to read as follows:
Sec. 505.406. SUICIDE PREVENTION TRAINING. (a) A license
holder shall complete six hours of suicide prevention training
approved by the department under Section 12.021, Health and Safety
Code, in the six years preceding the date the license holder applies
for renewal.
(b) The board may not renew the license of a license holder
who does not complete the training required by this section.
(c) A license holder may complete the training required by
this section:
(1) as part of the continuing education program under
Section 505.404; and
(2) in more than one training session.
SECTION 15. Not later than December 1, 2017, the Department
of State Health Services shall approve suicide prevention training
courses as required by Section 12.021, Health and Safety Code, as
added by this Act.
SECTION 16. The changes in law made by this Act apply only
to the renewal of a license or registration permit on or after
January 1, 2019.
SECTION 17. This Act takes effect September 1, 2017.
