| relating to reports to the legislature on administrative hearings | ||
| conducted by the State Office of Administrative Hearings. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter C, Chapter 2003, Government Code, is | ||
| amended by adding Section 2003.058 to read as follows: | ||
| Sec. 2003.058. QUARTERLY REPORTS TO LEGISLATURE. (a) Not | ||
| later than the 30th day following the end of each calendar quarter, | ||
| the office shall submit a report to the legislature indicating for | ||
| each county the total number of administrative hearings decided by | ||
| the office during the previous calendar quarter and, of those | ||
| hearings: | ||
| (1) the percentage in which the administrative law | ||
| judge decided in favor of the person who requested the hearing; and | ||
| (2) the percentage in which the administrative law | ||
| judge decided in favor of a state agency. | ||
| (b) Not later than the 30th day following the end of each | ||
| calendar quarter, each state agency shall submit a report to the | ||
| legislature indicating the total number of appeals from | ||
| administrative hearings held by the office that were decided during | ||
| the previous calendar quarter and, of those appeals: | ||
| (1) the percentage in which the court decided in favor | ||
| of the person who requested the hearing; and | ||
| (2) the percentage in which the court decided in favor | ||
| of the state agency. | ||
| SECTION 2. The State Office of Administrative Hearings and | ||
| each state agency subject to Section 2003.058, Government Code, as | ||
| added by this Act, shall submit the initial reports required by that | ||
| section not later than January 30, 2014, based on data from the | ||
| previous calendar quarter. | ||
| SECTION 3. This Act takes effect September 1, 2013. | ||
