| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 52.047, Government Code, is amended by | ||
| adding Subsection (h) to read as follows: | ||
| (h) A court reporter may not be required to file an official | ||
| transcript of a trial before the 60th day after the date a notice of | ||
| appeal is filed. To the extent this subsection conflicts with the | ||
| Texas Rules of Appellate Procedure or other rules of procedure, | ||
| this subsection controls. Notwithstanding Sections 22.003, | ||
| 22.004, and 22.108, the supreme court or the court of criminal | ||
| appeals may not amend or adopt a rule in conflict with this section. | ||
| This subsection does not apply to an official transcript required | ||
| for an accelerated appeal or an interlocutory appeal. | ||
| SECTION 2. The change in law made by this Act applies to a | ||
| notice of appeal that is filed on or after the effective date of | ||
| this Act. A notice of appeal filed before the effective date of | ||
| this Act is governed by the law in effect on the date the notice was | ||
| filed, and the former law is continued in effect for that purpose. | ||
| SECTION 3. This Act takes effect September 1, 2011. | ||
