A BILL TO BE ENTITLED
AN ACT
relating to the election of directors of certain electric
cooperatives.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter B, Chapter 161, Utilities Code, is
amended by adding Section 161.0721 to read as follows:
Sec. 161.0721. ELECTION OF DIRECTORS IN CERTAIN LARGE
COOPERATIVES. (a) This section applies only to an electric
cooperative with more than 200,000 members that is partially
located in a county with a population of more than one million and
less than 1.5 million.
(b) To be elected as director for a district, a candidate
must receive a majority of the total number of votes received for
that office.
(c) If no candidate for director of a particular district
receives the vote necessary to be elected, a runoff election for
that office is required.
SECTION 2. The changes in law made by Section 161.0721,
Utilities Code, as added by this Act, apply only to an election held
on or after the effective date of this Act. An election held before
the effective date of this Act is subject to the law in effect on the
date the election is held, and that law is continued in effect for
that purpose.
SECTION 3. This Act takes effect September 1, 2015.
