| relating to the use of certain voting equipment in an election that | ||
| does not involve a federal office. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 61.013, Election Code, is amended by | ||
| adding Subsection (a-1) to read as follows: | ||
| (a-1) This subsection applies to an election of a political | ||
| subdivision other than a county. Notwithstanding Subsection (a), | ||
| for an election of a political subdivision with a population of less | ||
| than 1,500, other than an election that is held jointly with another | ||
| election in which a federal office appears on the ballot, the | ||
| political subdivision is not required to meet the requirements of | ||
| Section 61.012(a)(1)(C) if the political subdivision: | ||
| (1) allows for a reasonable accommodation for a voter | ||
| with a disability in the manner provided by Subsection (b); | ||
| (2) provides notice to the secretary of state in the | ||
| manner required under Subsection (d)(1); and | ||
| (3) includes in the notice of election: | ||
| (A) a statement that the election will not meet | ||
| the requirements for accessibility described by Section | ||
| 61.012(a)(1)(C); and | ||
| (B) a description of the process by which a voter | ||
| with a disability may request a reasonable accommodation to vote in | ||
| the election. | ||
| SECTION 2. This Act takes effect September 1, 2011. | ||
