relating to the declaration of local disaster. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 418.108(i), Chapter 418, Government | ||
Code, is amended to read as follows: | ||
(i) A declaration under this section may, include a | ||
restriction that exceeds a restriction authorized by Section | ||
352.051, Local Government Code, if the Keetch-Byram Index level in | ||
Section 352.051(a)(2), Local Government Code, is exceeded and the | ||
governor has suspended the sale, dispensing, or transportation of | ||
the items in Section 418.019 within the county. A restriction that | ||
exceeds a restriction authorized by Section 352.051(c), local | ||
Government Code, is effective only: | ||
(1) for 60 hours unless extended by the governor; and | ||
(2) if the county judge requests the governor to grant | ||
an extension of the restriction. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all the members elected to each house, as | ||
provided by Section 39, Article III, Texas Constitution. If this | ||
Act does not receive the vote necessary for immediate effect, this | ||
Act takes effect September 1, 2011. |
