A BILL TO BE ENTITLED
 
AN ACT
  relating to the declaration of local disaster.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 418.108(i), Chapter 418, Government
  Code, is amended to read as follows:
         (i)  A declaration under this section may, include a
  restriction that exceeds a restriction authorized by Section
  352.051, Local Government Code, if the Keetch-Byram Index level in
  Section 352.051(a)(2), Local Government Code, is exceeded and the
  governor has suspended the sale, dispensing, or transportation of
  the items in Section 418.019 within the county.  A restriction that
  exceeds a restriction authorized by Section 352.051(c), local
  Government Code, is effective only:
               (1)  for 60 hours unless extended by the governor; and
               (2)  if the county judge requests the governor to grant
  an extension of the restriction.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
