| their dependents. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Section 1551.310, Insurance Code, is amended to | ||
| read as follows: | ||
| Sec. 1551.310. STATE CONTRIBUTION REQUIRED. (a) Subject to | ||
| Subsection (b), the [ |

| participant's group coverages, including dependents' group | ||
| coverages, the amounts appropriated for the coverages in the | ||
| General Appropriations Act. | ||
| (b) The state may not contribute more than 90 percent of the | ||
| amount that the state contributes for the group coverage of a | ||
| dependent under Subsection (a) for a spouse who participates in the | ||
| group benefits program in lieu of participating in another health | ||
| benefit plan in which the spouse is eligible to participate, | ||
| including a health benefit plan offered by the spouse's employer. | ||
| SECTION 2. The change in law made by this Act applies only | ||
| to group coverage provided under Chapter 1551, Insurance Code, for | ||
| a plan year beginning on or after September 1, 2011. A plan year | ||
| that begins before that date is governed by the law as it existed | ||
| immediately before the effective date of this Act, and that law is | ||
| continued in effect for that purpose. | ||
| SECTION 3. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2011. | ||
